Adair County Background Check Through the Circuit Court

The 2nd Judicial Circuit Court serves Adair County and handles all criminal, civil, traffic, and probate cases filed here. The courthouse is at 106 West Washington Street in Kirksville. This is where case files are kept. If someone was charged with a crime in Adair County, the record of that case lives in this court. The circuit clerk's office manages those files and can help you find what you need during business hours.

For a full criminal history check, the court points you to the Missouri State Highway Patrol. Under RSMo Chapter 43, the Highway Patrol's Criminal Justice Information Services division is the one central place that collects criminal records from every court and law enforcement agency in the state. That includes Adair County. So when you run a check through MACHS, it pulls records from here along with all other Missouri counties. A name-based search costs $15 and takes 5 to 7 business days. You start the process at machs.mo.gov.

Note: Local police in Adair County no longer run criminal history checks for the public as of July 2019.

Adair County Records and the Sunshine Law

Missouri's Sunshine Law gives you the right to access public records held by government bodies in Adair County. The law is in Chapter 610 RSMo. Under Section 610.023, every public body must have a custodian of records who handles requests. You can send a written request by mail or email to the Adair County office that holds the records you want. They have three business days to respond.

Section 610.026 sets the rules for fees. The county can charge for copies and for staff time spent finding the records. But if your request serves the public interest, a fee waiver may be possible. If Adair County denies your request, you have options. You can file a complaint with the Missouri Attorney General's Office or take the matter to court. Under Section 610.027, a court can order the release of records and impose fines up to $5,000 for knowing violations of the Sunshine Law.

This process applies to all records held by Adair County government offices. That includes the sheriff's department, the circuit clerk, the recorder of deeds, and any other county office. If the record exists and is not exempt under the law, you have the right to get a copy of it.

Adair County Sheriff and Local Background Check Records

The Adair County Sheriff's Office is in Kirksville. The sheriff keeps arrest records, incident reports, and jail booking records for the county. These are local records that cover what happens within Adair County. If you need a copy of a police report or want to check on a recent arrest, the sheriff's office is the place to start.

All arrest data from the Adair County Sheriff gets sent to the Highway Patrol's central database under RSMo 43.503. That means local arrests show up in the statewide system too. But the sheriff's office can only give you records from its own files. For a full background check that covers all of Missouri, you need to go through MACHS. The sheriff's office handles requests during regular business hours, Monday through Friday. You can submit a request in person or by mail. The office follows the same Sunshine Law rules as every other public body in Missouri.

The Adair County Recorder of Deeds keeps property records, liens, and other filed documents. These records can be part of a background check when you need to see if someone has judgments or liens filed against them in the county. The recorder's office is at the Adair County Courthouse in Kirksville.

Open and Closed Records in Adair County

Missouri law splits criminal records into two groups. Open records are the ones the public can see. Closed records are restricted. This matters when you run an Adair County background check.

Under Section 43.507 RSMo, open records include convictions, pending charges, arrests less than 30 days old, and cases with a suspended imposition of sentence while the person is still on probation. These show up on a MACHS name-based search. They also may appear on Case.net through the 2nd Circuit Court's public portal. Most of what you find in an Adair County background check falls into this group.

Closed records include dismissed cases, charges that were never filed, not guilty findings, and completed probation under a suspended sentence. The public cannot see these. Only the person named in the record, law enforcement, and certain authorized agencies have access. A fingerprint-based check through MACHS can pull both open and closed records, but results go only to the subject or an authorized party. Section 43.532 makes it a crime to share criminal history records without proper authority. If you need to see closed records tied to Adair County, the fingerprint route is the only legal path.
